The Czech Republic is one of the countries where citizens decide on public matters mainly through elements of representative, i.e. indirect, democracy. The institution of the referendum as an expression of direct democracy appeared in the modern history of Czechoslovakia shortly after the Velvet Revolution; before that, it had practically no tradition in our country.After an initial definition of the constitutional and international legal grounds for territorial referendums, the author outlines the development of legal regulations on referendums in matters of local government after 1989. It also focuses on analyzing the current legal regulation of local referendums under Law No. 22/2004 Coll., on local referendums, as well as clarifying the nature of judicial protection in referendum matters.
