The Legal Regulation of Religious Symbols in the Public Sphere in the Czech Republic
Popis výsledku v původním jazyce
The paper deals with religious symbols in public order in the Czech Republic. Based on a brief description of the formation of a new system of human rights protection after the fall of the communist regime in Czechoslovakia in 1989, it represents a constitutional and axiological grounding of the right to freedom of conscience and religion and its expression externally. After the introduction of the coordination system of relations between churches and religious communities in the Czech Republic, it presents the issue of the constitutional guarantee of the right to freedom of conscience and religion, the possibilities of their restriction and means of their protection, especially the Anti-Discrimination Act, and their regulation in common laws and in singular factual areas. Finally, it presents still rather sporadic case law of intrastate courts regarding religious symbols in public.
