Early Retirement Ages under Czech Law, Search for Equality in Social Security Law

References to aged or prematurely aged miners were used to justify a reduced retirement age and much higher pensions. Legislator used a Communist tool - the Employment Category to lessen the pre-retirement hardness of miners´ underground work. This article shows that the employment category is a broad sword rather than a scalpel, it is an instrument seasoned with a non-democratic ideology that is for various reasons inappropriate for the defined purpose. The regulated lower retirement age combined with lump-sum pensions more than doubles the estimated shorter life in retirement. To fullffil all conditions for early miners´retirement, miners are forced to remain in this occupation at atny cost. Instead of eradicating age discirimination, the Reform of 2016 created a new age threshold for miners without any clear reasoning, apart from the anticipated closure of one mine that was not realised in the end.
