What we talk about when we talk about rights of future generations in climate litigation?
Popis výsledku v původním jazyce
This contribution focuses on granting standing to future generations in existing climate change case law. First, the contribution presents some findings on theory and then moves to case study. As an example of positive approach of the court in granting standing to future generations in environmental issues is demonstrated the case Minors Oposa from 1994. Then, current Climate change litigation cases involving children, youth or future generations are analysed. The contribution identifies several ways the courts are approaching standing to future generations: negative, avoiding, positive, and some border approaches. Finally, this contribution argues, that he success of Oposa was already reached in Climate change litigation (see Urgenda, Future Generations, Neubauer, or Milieudefensie).n
