Este capítulo aborda un fenómeno relativamente nuevo: la justicia intergeneracional en los litigios climáticos. Aunque los litigios climáticos relativos a los derechos de los jóvenes y de las generaciones futuras, así como la erudición que analiza esta tendencia, van en aumento, aparecen lagunas a la hora de distinguir entre los derechos de los menores o jóvenes y los de las generaciones futuras, como generaciones que existirán en algún momento en el futuro. Este capítulo, por tanto, pretende analizar dos tipos de casos climáticos: en primer lugar, los casos climáticos que afectan tanto a los jóvenes como a las generaciones futuras, en los que los jóvenes actuan como puente entre las generaciones actuales y las futuras, y, en segundo lugar, los casos centrados únicamente en las «generaciones futuras», sin que hayan sido presentados especialmente por jóvenes demandantes. La estructura del capítulo es la siguiente: la primera parte ofrece una visión general del concepto de justicia intergeneracional y su integración en el sistema jurídico, a continuación, la segunda parte introduce la litigación climática relativa a menores y los derechos de las generaciones futuras, luego, la tercera parte efectúa un análisis de los criterios de los tribunales para otorgar capacidad jurídica activa a las generaciones futuras, identificando tres posibles enfoques: negativo, evasivo y positivo.

This chapter deals with a relatively new phenomenon: intergenerational justice in climate litigation. Although climate litigation concerning the rights of youth and future generations, and also scholarship analyzing this trend, is on the rise, gaps in distinguishing between the rights of minors or young people, and future generations, as generations that will exist sometime in the future, appear. This chapter, therefore, aims to analyze two types of climate cases: first, climate cases involving both youth and future generations, where young people may be understood as a bridge between current and future generations, and, second, cases focused only on ‘ future generations ’ , without being brought especially by young plaintiffs. The structure of the chapter is as follows: the first part provides an overview of the concept of intergenerational justice and its integration into the legal system, then the second part introduces climate litigation concerning children and the rights of future generations, Part 3 then provides an analysis of the court's approaches to granting standing to future generations, identifying three possible approaches: negative, avoidance and positive.
