Studie představuje aktuální trendy v kontrolní činnosti Národního archivu a přestupková řízení v oblasti spisové služby vedená s původci. Nejprve stručně zasazuje kontrolní a sankční nástroje do celku předarchivní péče, kam neoddělitelně patří. Jádro textu tvoří dvě části: První část je věnována kontrolní činnosti Národního archivu. Přináší souhrnné informace o okruhu veřejnoprávních původců podléhajících kontrole a o typologii kontrol a podrobněji nastiňuje cíle a účel kontrolní činnosti Národního archivu. Druhá část je zaměřena na problematiku přestupkového řízení. Nejprve stručně shrnuje vymezení spisových přestupků v současné právní úpravě a představuje typologii přestupkových řízení vedených Národním archivem. Největší pozornost je pak zaměřena na představení problémů aplikační praxe současné legislativní úpravy spisových přestupků v širších souvislostech a dalších (nelegislativních) omezení, která omezují efektivní postih protiprávního jednání původců v této oblasti.

To help by controlling and punishing...?! The use of control and sanctioning tools in the National Archives' relations with public originators in its pre-archival care and their role in the process of forming archival collections: possibilities and limits

The study presents current trends in the control activities of the National Archives and misdemeanour proceedings in the field of records management conducted with originators. First, it briefly situates the control and sanctioning tools within the whole of pre-archival care, where they inseparably belong. The core of the text consists of two parts: The first part is devoted to the control activities of the National Archives. It provides summary information on the range of auditable public originators and the typology of audits, and outlines in more detail the objectives and purpose of the National Archives' auditing activities. In the next part, it presents the usual course of the inspection (the methodology of the work of the inspection groups), notes the legal framework and the changes in the breadth of the scope of inspections in the past period, recapitulates specific problems in the performance of inspection activities, as well as special tools used during inspections, and finally presents the most frequent and most serious defects detected, while this part is enriched and suitably supplemented by a pictorial appendix. Finally, it presents a specific (atypical) example from the "control" practice (several years of unsuccessful attempts to control the performance of the file service at the High State Prosecutor's Office in Prague). The second part focuses on the issue of misdemeanour proceedings. First, it briefly summarises the definition of filing offences in the current legislation and presents the typology of offence proceedings conducted by the National Archives. Most attention is then focused on presenting the problems of the application practice of the current legislative regulation of filing offences in a broader context and other (non-legislative) limitations that restrict the effective punishment of illegal actions of originators in this area, while at the same time possible ways and means of eliminating them are also outlined. Finally, in the second part, the paper presents in more detail the "misdemeanour case of the decade" (in the area of file service) - the misdemeanour proceedings with the Office of the President of the Republic. The aim of the study is to contribute to a balanced perception of the control and sanctioning tools of the archive within the instrumentarium of pre-archival care, without polarization (absolutization × marginalization), and to show their usefulness both for the archive (and its archival files) and for the originators.
