While it has been argued that the crucial difference between international and hybrid tribunals lies in the alleged authority of the former to set aside the personal immunities of members of the troika, it is submitted here, that under the current rules of customary international law, a treaty-based international criminal tribunal is equally unable to set aside the personal immunity of an official of a state not party to the treaty constituting such an international tribunal.
