Realisation of the Right to Interpretation and Translation in Czech Criminal Proceedings and its Possible Misuse
Popis výsledku v původním jazyce
In his chapter author discusses the right to interpretation and translation in criminal proceedings which follows from the right to a fair trial. He also mentions the new Directive of the European Parliament and of the Council of 20 October 2010 on the right to interpretation and translation in criminal proceedings. He describes how the aforementioned right is regulated in Czech national regulations. The author analyses it and points out that the Czech regulation is not capaable of ensuring compliance with the obligations following from the Directive. In this respect, he contemplates on the development of draft legislation concerning the status of interpreters that could substantially contribute to the compliance with the obligations following from theDirective. He also points out how the right to interpretation and translation can be misused for causing delays in criminal proceedings.
