Czech Civil Service in Context of Selected Recent European Courts' Decisions

Czech civil service is currently governed by Labour Code as the Civil Service Act enacted in 2002 has not become effective yet. As a result of the EU criticism and the deadline to correct the insufficiencies set for 31st December 2013, new legislation ora mere amendment to the Civil Service Act based on public law regulating method is expected to be adopted soon. Administrative courts will thus newly adjudicate cases of public officials' recruitment, remuneration, disciplinary actions and dismissal from service. The article deals with principles of civil service which are common to the whole of Europe. Further, it shows the necessity of access to court in civil service cases, and that the major tendency in those decisions is extending the scope of judicial review and its standards. It demonstrates on selected examples, that decisions of European courts might be used as a potential inspiration when developing new Czech case law.
