The national arbitration laws and most rules of permanent arbitral institutions allow the parties to freely choose not only the procedural provisions applicable to the proceedings, but also applicable substantive law. However, the rules of permanent arbitral institutions simultaneously provide a wide margin of discretion to the arbitrators in determining the substantive law applicable to the subject matter of the dispute, to an extent which would be unacceptable in court proceedings. Consequently, the internationalized and sometimes almost denationalized procedures in arbitration do not consider any specific substantive law to be the basis for the assessment of the merits; according to these theories, this assessment is based primarily on contract.
