Special Feature of Legal Protection in Austria: Independent Administrative Senats

The author focuses in her paper on position and functioning of the Austrian independent administrative senats and their role in protection of rights. The independent administrative senats represent provincial administrative authorities which are responsible to the provicincial governments. The independent administrative senats were established since January 1st, 1991 and there is always one independent administrative senat in every province. According to the Art. 129 of the Austrian Federal Constitutionthe independent administrative senats are together with the Administrative Court of Justice competent to control of public administration in terms of legality. Recently there is a proposal to convert the independent administrative senats into the real administrative courts.
