Since the financial and the Eurozone crisis, the rules on the functioning of the Economic and Monetary Union have changed in a fundamental way. I argue in this article on an example of three specific policies that in their sum, they are moving the balance national to supranational institutions and lead us in the direction, frequently referred to as “fiscal federation”. At the same time, I argue that these changes are not fully in line with the EU primary law, as it stands today. Far from contradicting the necessity and effectiveness of these measures on economic terms, I put forward that in order to accommodate this substantially modified architecture of EMU, it would be beneficial to change the primary law first and make the EMU rules absolutely clear.
