Popis výsledku v původním jazyce
Th is chapter aims to analyse the possibilities and limits of using videoconferencing in administrative proceedings in the Czech Republic. Th e basicresearch question is whether and under what conditions videoconferencingcan be considered a procedurally admissible and constitutionally acceptablemethod of conducting oral proceedings. Th is question is followed by othersub-questions: how can videoconferencing ensure respect for the principlesof immediacy, publicity and equality of participants in proceedings; whatguarantees must be provided by law to prevent the procedural rights of participants from being curtailed; and fi nally, whether, from the point of viewof the legal system, it is more appropriate to have a general regulation allowing videoconferencing with the possibility of exceptions laid down by speciallaws, or, on the contrary, to maintain the current model, where their use isregulated only on a case-by-case basis. Th e aim of the text is to provide a basis for de lege ferenda considerations on the general incorporation of videoconferencing into Czech administrative law
