Ústavní ochrana hotovosti je v posledních letech diskutována v mnohých zemích a také v mnohých podobách. Domnívám se však, že v současném diskurzu je často opomíjena komplexnost tohoto práva. Ve svém příspěvku rozvinu myšlenku, že tato komplexnost pramení zejména ze skutečnosti, že se pod stejnou hlavičku subsumují dvě odlišná práva. Jde o právo 1) provádět a přijímat platby v hotovosti a 2) právo na hotovost (zachování hotovosti). Zároveň představím argumenty, proč zavést do ústavy právo na hotovost a proč naopak nikoli. Strukturu svým argumentů opřu o argumenty zaznívající v současné debatě o předposledním návrhu na zavedení tohoto práva. V každém tomto argumentu představím dvě roviny odpovídající dvou právům skrytým v právu na hotovost.Úvodem svého příspěvku představím současný stav právní úpravy a zároveň nastíním okolnosti, za kterých se právo na hotovost začalo v České republice probírat, konkrétně spor o interpretaci mezi ČNB a Ministerstvem financí. Poté se přesunu k jednotlivým argumentům.Argumentem, který často zastiňuje všechny ostatní, bývá sociální rovina, tedy ochrana těch, kteří bezhotovostně platit neumí. V tomto ohledu mohou být často zmiňováni lidé ze starších generací, byť úskalí technologií nemusí postihovat pouze je. Ve svém příspěvku tuto problematiku hlouběji rozvinu. Tento argument však není jediným a dle mého názoru ani tím nejzásadnějším.Druhou rovinu, kterou rozvinu je otázka svobodného rozhodování plátců a ústavou zaručenými právy druhých, se kterými se dostává do konfliktu. Příkladem může být konflikt se svobodou podnikání. Podle průzkumu 200 podnikatelů z roku 2024 si 63 % myslí, že by stát neměl způsob přijímaní plateb regulovat, a 20 % je spokojeno s aktuálním stavem. Problémem toho může být nejen přidaná práce pro prodávající, ale také náklady na zprostředkování. Ty se pohybují od 1 do 4-5 % z transakce, průměrná částka odvedená bance je 0,45 %, karetní asociaci 0,20 %, zpracování transakce stojí asi 0,5 Kč a servis terminálu nejméně na 290 Kč měsíčně.Třetím argumentem je zásah do práva na soukromí. S bezhotovostním placením vždy přichází do vztahu třetí strana - banka. Účet v bance je k tomu podmíněn poskytnutím velkého množství informací. Prvotní informace jsou získávané již při identifikaci, Česká národní banka zdůrazňuje že neposkytnutí požadovaných informací pro účely identifikace a kontroly klienta může vést k odmítnutí navázání obchodního vztahu nebo k jeho ukončení. Pokud pomineme prvotní identifikace, banka má přístup k historii všech pohybů na vašem účtu. To sice může znít neškodně, ale pokud by klient vše nakupoval z účtu u jedné banky má banka přehled nejen o platbách tohoto klienta, ale může poměrně dobře analyzovat i jeho pohyb a další informace o jeho životě.Všechny tyto informace aktuálně chrání bankovní tajemství, zahrnuje veškeré bankovní obchody, peněžní služby a stavy na účtech klientů. Nicméně v souladu se zákonem o bankách existují případy, kdy banka musí poskytnout tyto informace na písemné vyžádání specifických orgánů.Pokud by tak zmizela možnost platit hotově, znamenalo by to, že banka a teoreticky i stát dostane, ač částečný, přístup k poměrně uceleným informacím o životu jedince. To může být využito například ke kontrole podobné aktuálnímu systému v Číně. Zneužití ale může nastat i v jiných zemích, a to ať třetí stranou nebo samotným státem. Na velmi tenké hranici se v tomto případě pohybovala Kanada, kde v roce 2022 vláda poprvé aktivovala Zákon o mimořádných událostech a zmrazila bez soudního příkazu více než 206 bankovních účtů protestujících Freedom Convoy.Čtvrtým argumentem, který představím, je riziko blackoutu a technickou rovinu. V současné době by při výpadku proudu došlo k selhání elektronického bankovnictví, bankomatů a platebních terminálů. Pokud by byl návrh ústavního zákona o ochraně hotovosti přijat, zaručená existence hotovosti by mohla ochránit záložní platební metodu, alespoň v dnešní míře její existence.Pátým a podle mě nejzásadnějším argumentem, který rozvinu, je ekonomická rovina. Jak už bylo zmíněno výše, do platebních vztahů vstupuje bezhotovostní platbou třetí strana - banka. To by nemuselo vést pouze k omezení soukromí, ale i možné kontrole například nad tím, co, kdo a kde smí kupovat. Některé banky již nyní projevují snahu omezovat služby podnikatelům, jejichž činnosti se jim nelíbí, i když jsou legální, jen například v nesouladu se zelenou politikou EU.Jedním z hlavních argumentů pro ochranu fyzické hotovosti bývá také ochranná funkce proti snadnému zavedení záporných úrokových sazeb ze strany centrální banky. Pokud by banky začaly uplatňovat záporné úrokové sazby na vklady, efektivně by znehodnocovaly digitální peníze, které lidé a firmy drží na účtech. Lidé by ale již neměli možnost vybrat své vklady a držet je ve fyzické hotovosti. Tím by se kompetence, které se nápadně podobají daňovým kompetencím, které tradičně náleží zákonodárnému sboru, fakticky přesunuly na centrální banky.Nutné je přemýšlet i o situaci, kdy by se postupně schopnost platit v hotovosti začala na trhu výrazně snižovat, ale lidé by z výše zmíněných důvodů ztratili důvěru v banky a snažili by se peníze rychle převádět mimo systém. Tento scénář by mohl způsobit i tzv. run na banky, tedy situaci, kdy velký počet vkladatelů hromadně vybírá své peníze z banky z obavy o její stabilitu. Pro ochranu vkladatelů v případě krachu banky nebo její neschopnosti dostát závazkům funguje v České republice systém pojištění pohledávek z vkladů. Ten aktuálně pojišťuje klienty do maximální výše pojištěného vkladu 100 000 EUR, a v některých výjimečných případech 200 000 EUR na jednoho vkladatele u jedné banky. Otázkou zůstává, co by se stalo, kdyby hotovost neexistovala a občané v bankách neměli jen část, ale všechny své prostředky na svých bankovních účtech. Ačkoliv se nyní nikdo o zrušení hotovosti v Česku jako takové nepokouší, diskuze o tomto směru do budoucna je stále častější.Ve svém příspěvku výše zmíněné roviny rozvedu stejně tak jako představím možné protiargumenty k nim. Zároveň demonstruji skutečnost, že jednotlivé aspekty lze rozdělit do dvou skupin odpovídajících právě dvěma právům, ze kterých se právo na hotovost skládá, a že by toto dělení mohlo pomoci konstruktivnější debatě na dané téma.

The constitutional protection of cash has been debated in many countries in recent years, and in many different forms. However, I believe that the current discourse often overlooks the complexity of this right. In this paper, I will explore the idea that this complexity stems primarily from the fact that two distinct rights are subsumed under the same heading. These are 1) the right to make and receive cash payments and 2) the right to cash (preservation of cash). At the same time, I will present arguments for and against enshrining the right to cash in the constitution. I will structure my arguments based on those raised in the current debate regarding the penultimate proposal to introduce this right. In each of these arguments, I will present two dimensions corresponding to the two rights inherent in the right to cash.I will begin my contribution by presenting the current state of the legal framework and, at the same time, outlining the circumstances under which the right to cash began to be discussed in the Czech Republic, specifically the dispute over interpretation between the Czech National Bank and the Ministry of Finance. I will then move on to the individual arguments.The argument that often overshadows all others is the social dimension, namely the protection of those who are unable to make cashless payments. In this regard, people from older generations are often mentioned, although the pitfalls of technology do not necessarily affect only them. I will explore this issue in greater depth in my paper. However, this argument is not the only one, nor, in my opinion, the most fundamental.The second aspect I will explore is the issue of payers' freedom of choice and the constitutionally guaranteed rights of others, with which it comes into conflict. An example of this is the conflict with the freedom of enterprise. According to a 2024 survey of 200 entrepreneurs, 63% believe that the state should not regulate the method of accepting payments, and 20% are satisfied with the current situation. The problem with this may be not only the added work for sellers but also the costs of intermediation. These range from 1% to 4-5% of the transaction; the average amount paid to the bank is 0.45%, to the card association 0.20%, transaction processing costs about 0.5 CZK, and terminal service at least 290 CZK per month.The third argument concerns the infringement of the right to privacy. Cashless payments always involve a third party-the bank. Opening a bank account requires providing a large amount of information. Initial information is collected during the identification process; the Czech National Bank emphasizes that failure to provide the required information for client identification and verification purposes may lead to the refusal to establish a business relationship or to its termination. Setting aside the initial identification process, the bank has access to the history of all transactions in your account. While this may sound harmless, if a client makes all purchases from an account at a single bank, the bank not only has an overview of that client's payments but can also fairly accurately analyze their spending patterns and other information about their life.All of this information is currently protected by bank secrecy, which covers all banking transactions, financial services, and client account balances. However, in accordance with the Banking Act, there are cases in which a bank must provide this information upon written request from specific authorities.If the option to pay in cash were to disappear, it would mean that the bank-and theoretically the state as well-would gain, albeit partial, access to relatively comprehensive information about an individual's life. This could be exploited, for example, for surveillance similar to the current system in China. However, abuse can also occur in other countries, whether by a third party or by the state itself. Canada walked a very fine line in this regard when, in 2022, the government invoked the Emergencies Act for the first time and froze more than 206 bank accounts belonging to Freedom Convoy protesters without a court order.The fourth argument I will present concerns the risk of a blackout and the technical aspect. Currently, a power outage would cause electronic banking, ATMs, and payment terminals to fail. If the proposed constitutional law on cash protection were adopted, the guaranteed availability of cash could safeguard a backup payment method, at least to the extent it currently exists. The fifth and, in my view, most crucial argument I will discuss is the economic aspect. As mentioned above, cashless payments involve a third party-the bank-in payment transactions. This could lead not only to a restriction of privacy but also to potential control over, for example, what, who, and where people are allowed to buy. Some banks are already showing a tendency to restrict services to businesses whose activities they disapprove of, even if they are legal, simply because they are, for example, inconsistent with the EU's green policy.One of the main arguments for protecting physical cash is also its protective function against the central bank's easy introduction of negative interest rates.If banks were to start applying negative interest rates to deposits, they would effectively devalue the digital money that people and businesses hold in their accounts. However, people would no longer have the option to withdraw their deposits and hold them as physical cash. This would effectively shift powers-which bear a striking resemblance to the tax powers traditionally held by the legislature-to central banks.It is also necessary to consider a situation where the ability to pay in cash would gradually begin to decline significantly in the market, but people would lose confidence in banks for the reasons mentioned above and would try to quickly transfer their money out of the system. This scenario could also trigger a so-called bank run-a situation where a large number of depositors collectively withdraw their money from a bank out of concern for its stability.To protect depositors in the event of a bank failure or the bank's inability to meet its obligations, the Czech Republic operates a deposit insurance system. This system currently insures clients up to a maximum insured deposit of EUR100,000, and in some exceptional cases, EUR200,000 per depositor at a single bank. The question remains: what would happen if cash did not exist and citizens kept not just a portion, but all of their funds in their bank accounts? Although no one is currently attempting to abolish cash in the Czech Republic as such, discussions about this direction for the future are becoming increasingly common.In this article, I will elaborate on the aforementioned points and present possible counterarguments to them. At the same time, I will demonstrate that the individual aspects can be divided into two groups corresponding to the two rights that constitute the right to cash, and that this division could contribute to a more constructive debate on the topic.
