In the Member States of the European Union (and beyond their borders), employment relationships with employees are terminated on a daily basis. Some employees challenge the validity of such legal acts and often successfully use the remedies provided for by national law. However, the procedure from the termination of the employment relationship to the final determination of its ineffectiveness (nullity) can be long and complex. The case law of the Czech courts – similar to the case law of courts in other countries – has been resolving claims arising from the unlawful termination of employment for years. It has become established that during the special “period of uncertainty”, which includes the period from the contested termination of the employment relationship to the date of the final court decision, the employment relationship is not governed by the employment contract, collective agreement, internal regulations or the relevant provisions of labor law, as if they were still in force. Therefore, during this period, the employee is not entitled to the monetary equivalent for unused vacation under the Czech Labor Code.
