Unlawful Termination of an Employment from the Perspective of Czech and European Case Law
Popis výsledku v původním jazyce
The article explores the regulation of dependent work and the protection of employees in vulnerable situations, particularly disputes over the unlawful termination of employment relationships. It examines Czech legislation and case law, focusing on the overlap between entitlement to early retirement pensions and wage or salary compensation in cases of unlawful termination. Additionally, it addresses the issue of annual leave entitlement when an employer fails to assign work due to unlawful termination. Using examples from Czech court rulings, the article highlights the need for robust employee protections through social law, appropriate regulations, and judicial practices aligned with European Union legal frameworks. This analysis is relevant not only in the Czech Republic but also for individuals across the European Union.
