Duties and options of employer during employee's temporary incapacity for work

Temporary incapacity for work is a topic involving legal, economic, social and medical aspects. The paper deals with a Czech legal regulation of this topic aiming at pointing to its social aspects. If the law is generally understood as one of the tools to realize social policy of the state, then legal regulation of some labour-law institutes is the tool to realize social policy at the level of employer in the frame of his personnel agenda. When analysing selected duties and options given to employer by the law (as it comes to employee's temporary incapacity for work) and pointing out some problems in practical application, such hypothesis can be proved that legal regulation of this topic has social aspects. Based on this paper elaboration, the following results have occurred: 1) employers have to respect given duties determined by the law, 2) emplyoers can use options given them by the law, and 3) employers can also use an absence of some questions being not regulated by the law and arrange their own social benefits for the employees. The legal regulation thus significantly influences employer's decision-making in both the question of temporary incapacity for work and his entire social policy concept
